Terms of Use — Sports Dynasty: Football

1. Agreement and who we are

In these Terms, “we”, “us” and “our” mean the developer of the Game (see Contact and developer details).

By downloading, installing or using the Game, you agree to these Terms. If you do not agree, please do not use the Game and uninstall it.

Our Privacy Policy explains how data is handled when you use the Game. It is a separate document and does not form part of these Terms. It also explains your data protection rights and how to contact a data protection authority.

2. Eligibility

• The Game is intended for a general audience aged 13 and over. It is not directed to children under 13.
• If you are under the age of majority in your country, you may use the Game only with the involvement of a parent or legal guardian, who should review these Terms with you.
• If you are a minor, you must have the permission of a parent or legal guardian before making any in-app purchase. Parents and guardians can use the purchase controls offered by the app store (for example, purchase authentication or family settings) to manage purchases.
• In some countries the age of digital consent is higher than 13 (up to 16 in some EU countries). Where the law requires it, a parent or guardian must give consent on your behalf.

3. License and restrictions

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the Game on devices you own or control, for your own personal, non-commercial entertainment. The Game is licensed, not sold.

You must not:

• copy, modify, translate, decompile, disassemble or reverse engineer the Game, or attempt to derive its source code, except to the extent that such restriction is prohibited by applicable law;
• cheat, or use hacks, mods, bots or other unauthorized tools to alter the Game, its save or data files, in-game currency or items, or advertising and reward mechanics;
• tamper with, bypass or interfere with purchase processing or purchase verification, or obtain paid content without paying for it;
• sell, rent, lease, sublicense, distribute or otherwise exploit the Game or any part of it (including in-game currency, items or accounts of any kind) for commercial purposes;
• remove or alter any copyright, trademark or other notices in the Game;
• use the Game in any way that breaks the law or infringes the rights of others.

Nothing in these Terms limits any right you have under applicable law that cannot be restricted by contract.

4. App store terms

You obtain the Game through an app store, and the store’s own terms also apply to your download and purchases:

• If you use the Android version from Google Play, the Google Play Terms of Service apply.
• If you use the iOS version from the Apple App Store (once available), the Apple Media Services Terms and Conditions apply, together with the additional terms for the Apple App Store version below.

If these Terms conflict with the store’s terms on a matter the store controls (such as payment processing and store refunds), the store’s terms prevail for that matter.

5. In-app purchases

The Game is free to download. It offers optional in-app purchases. There are no subscriptions and no randomized paid items (“loot boxes”).

Payments and prices

• All purchases are processed by the app store (Google Play on Android; the Apple App Store for the iOS version, where available). We never receive your card or payment details.
• The price that applies is the price shown in the store at checkout, in your local currency and including any taxes the store applies. Prices shown elsewhere may be indicative only.
• Purchases are verified on your device. The Game does not use an account system or our own servers.

Premium unlocks (non-consumable)

• Premium is a one-time purchase that removes interstitial (full-screen, between-screens) ads. It does not remove optional rewarded ads: these remain available if you choose to watch them, and some optional features (for example, changing your stadium’s style) are unlocked by watching a rewarded ad, including for Premium owners.
• Premium Plus is a one-time purchase that includes the Premium benefit (no interstitial ads) and additionally grants a one-time bundle of in-game resources (in-game cash in owner mode; coach experience, staff and player development points and a game boost in coach mode). The one-time bundle is credited once per device, to your current game, and is treated like other virtual items described below.
• If you reinstall the Game or move to a new device using the same store account, you can use the “Restore purchases” button in the in-game shop to restore your Premium or Premium Plus status. Restoring is intended to restore the ad-free status; it does not guarantee that one-time bundles of virtual items are credited again.

Virtual items, in-game cash and points (consumable)

The Game offers consumable purchases of in-game cash, points (such as coach experience and development points) and boosts, and you can also earn in-game currency and items through play and optional rewarded ads (together, “virtual items”). You agree that:

• virtual items have no real-world monetary value, cannot be exchanged for real money, goods or services, and cannot be sold, transferred or gifted to anyone else;
• you receive a limited license to use virtual items within the Game only; you do not own them;
• once credited, consumable purchases are non-refundable, except where required by applicable law or by the store’s refund policy;
• virtual items are tied to the local save on your device. The Game has no cloud save and no account, so virtual items and progress are lost if the local data is lost — for example, if you uninstall the Game, clear its data, reset or lose your device, or delete a save — unless you have your own device backup from which the data is restored. We cannot recover or re-credit lost virtual items;
• we may adjust the balance, effects or availability of virtual items as part of updates to the Game, to the extent permitted by law, without affecting items you have already purchased in a way that is unfair to you.

If a purchase was charged but not delivered, please first try “Restore purchases” (for Premium) or restart the Game, and then contact us or the store.

6. Refunds

Because purchases are processed by the app store, refund requests are handled under the store’s refund policy:

• Google Play: see Google Play refund policies.
• Apple App Store (iOS version, where available): you can request a refund at reportaproblem.apple.com.

You can also contact us (see Contact and developer details) and we will try to help. We do not have the technical ability to issue refunds for store purchases ourselves.

This does not limit your mandatory rights as a consumer. In particular, if you are a consumer in the EU/EEA, you have a legal guarantee that digital content you buy conforms to the contract (Directive (EU) 2019/770), and this guarantee cannot be excluded. Refunds made by the store may cause the corresponding virtual items or Premium status to be removed.

7. EU right of withdrawal

If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from a contract concluded at a distance. For digital content that is not supplied on a tangible medium (such as Premium unlocks and virtual items), this right ends once supply of the content has started, provided that you gave your express prior consent to immediate supply and acknowledged that you would thereby lose your right of withdrawal. This consent and acknowledgement are collected by the app store at checkout. Your other statutory rights, including the legal guarantee of conformity, are not affected.

8. Advertising and rewarded ads

• The Game shows ads provided by Google AdMob. Interstitial ads appear at a limited number of points in a season (for example, at season start, mid-season and before the playoffs) unless you have purchased Premium or Premium Plus.
• Rewarded ads are always optional. If you choose to watch one, the reward (for example, an in-game cash bonus in the shop, or a change of stadium style) is granted only after the ad has been watched to completion. Closing an ad early may mean no reward is given.
• Rewarded ads may be subject to daily limits, and ad availability is not guaranteed: ads may not be available at all times, in all regions, when you are offline, or depending on your consent choices. We are not obliged to provide a reward if no ad can be shown.
• Ads are created and served by third parties. We do not control their content and are not responsible for third-party products or websites you reach through an ad. How ad-related data is processed is explained in our Privacy Policy.
• Rewards from ads are virtual items and are subject to Section 5.

9. Your content

The Game lets you create or bring in your own content, such as team names and cities, your owner name, custom logo images you import from your device, and league files you import (“your content”).

• Your content stays on your device. We do not receive or host it. (Note that team city and name may form part of analytics data as described in the Privacy Policy.)
• You keep whatever rights you have in your content. You are responsible for making sure you have the necessary rights to any images, names, logos or files you import or create.
• Your content must not be unlawful, and must not infringe anyone’s copyright, trademark, privacy or other rights. For example, do not import logos or trademarks of real sports teams or leagues unless you have the right to use them.
• The Game lets you export a league file and share it through your device’s share sheet. If you share an exported file, you choose who receives it and you are responsible for that sharing and for the content of the file.
• We may remove or disable features that allow imported content if needed to comply with the law.

10. Fiction, no affiliation and our intellectual property

Sports Dynasty: Football is a work of fiction. The teams, players, coaches, staff, leagues and events in the Game are fictional. The Game is not affiliated with, endorsed by, sponsored by or licensed by any real professional or amateur sports league, team, or players’ association. Any resemblance to real persons, teams or organizations is coincidental.

The Game, including its software, design, text, graphics, sounds, and all related intellectual property rights, is owned by us or our licensors and is protected by law. Except for the limited license in Section 3, no rights are granted to you. Third-party names and trademarks referred to in these Terms (such as Google Play and Apple App Store) belong to their respective owners.

11. Updates, changes and discontinuation

• We may release updates that fix issues, add, change or remove features, or adjust game balance. Some updates may be necessary for the Game to keep working properly. Where you are a consumer in the EU/EEA, we will provide updates necessary to keep the Game in conformity as required by law.
• We may modify features of the Game for valid reasons (for example, technical, legal or security reasons, or to adapt to store requirements). If a change negatively affects your access to or use of paid digital content in more than a minor way, we will inform you in advance and you may have rights under applicable law.
• We may stop offering or supporting the Game, or remove it from app stores. Because the Game runs offline, an installed copy may continue to work, but we cannot guarantee this indefinitely (for example, on future operating system versions). Where required by law, we will give reasonable notice and respect your statutory rights in relation to paid content.

12. Termination

• You may stop using the Game at any time by uninstalling it. Uninstalling or clearing app data deletes your local saves and virtual items.
• If you materially breach these Terms (for example, by tampering with purchase verification or commercially exploiting the Game), your license ends automatically, to the extent permitted by law.
• Sections that by their nature should continue after termination (including Sections 10, 13, 14, 15 and 17) survive.

13. Disclaimers

To the maximum extent permitted by law, the Game is provided “as is” and “as available”. We do not promise that the Game will be uninterrupted, error-free or compatible with every device, or that saves will never be lost or corrupted. The Game is a simulation for entertainment; its results are not predictions or advice about real sports.

Nothing in these Terms excludes or limits any warranty or guarantee that cannot be excluded or limited under applicable law, including the EU/EEA legal guarantee of conformity for digital content. Nothing in these Terms affects your statutory rights as a consumer.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of in-game progress, saves or virtual items caused by events outside our reasonable control, such as uninstalling the Game, clearing data, device loss or failure.

Nothing in these Terms excludes or limits our liability:

• for damage caused intentionally or through gross negligence;
• for death or personal injury caused by our negligence;
• for fraud or fraudulent misrepresentation; or
• for any other liability, or any consumer right, that cannot be excluded or limited under applicable law.

15. Questions and governing law

• If something goes wrong, please write to us first (see Contact and developer details) — we will do our best to help.
• These Terms are governed by the laws of the country where we are established (see Contact and developer details). If you are a consumer, you keep the mandatory protections of the law of the country where you live.

16. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Game or to the law. We will update the “Last updated” date at the top of this page and, where changes are material, highlight them on this page or in the Game where appropriate. Changes do not apply retroactively. If you continue to use the Game after the changes take effect, the updated Terms apply; if you do not agree, you may stop using the Game.

17. Severability

If any provision of these Terms is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

18. Entire agreement

These Terms (including the additional terms for the Apple App Store version, where they apply) are the entire agreement between you and us regarding the Game, and replace any earlier terms. The app store’s terms apply alongside them as described in Section 4. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor of the Game, provided that this does not reduce your rights as a consumer.

19. Additional terms for the Apple App Store version

This section applies only if and when an iOS version of the Game is available and you obtained it from the Apple App Store. The Game is currently available for Android only. If this section conflicts with the rest of these Terms, this section prevails for the iOS version.

1. Acknowledgement. These Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the Game and its content.
2. Scope of license. The license granted to you for the iOS version is a non-transferable license to use the Game on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Game may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where applicable.
3. Maintenance and support. We are solely responsible for providing any maintenance and support services for the Game, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Game.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Game to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Game, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility, to the extent not effectively disclaimed.
5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the Game or your possession and/or use of the Game, including: (i) product liability claims; (ii) any claim that the Game fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. These Terms do not limit our liability to you beyond what is permitted by applicable law.
6. Intellectual property rights. In the event of any third-party claim that the Game or your possession and use of the Game infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints or claims regarding the Game should be directed to the developer at the name, address and email listed in Contact and developer details.
9. Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using the Game (for example, the terms of your wireless data service provider).
10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
