Terms of Use — Art Master: Art History Quiz
These Terms of Use (“Terms”) govern your use of the mobile app Art Master: Art History Quiz (the “App”). In short: the App is an art history quiz for a general audience aged 13 and over; an optional Premium subscription is sold and managed through Google Play and renews automatically until you cancel it; the free version shows ads; lives and other in-app features have no monetary value; quiz content is provided for entertainment and education and may contain errors; and the artworks shown in the App come from public museum collections and Wikimedia and remain the property of their respective rights holders. Please read the full Terms below.
1. Agreement and who we are
In these Terms, “we”, “us” and “our” mean the developer of the App (see Contact and developer details).
By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App and uninstall it.
Our Privacy Policy explains how data is handled when you use the App. It is a separate document and does not form part of these Terms.
2. Eligibility
- The App is intended for a general audience aged 13 and over. It is not directed to children under 13.
- If you are under the age of majority in your country, you may use the App only with the involvement of a parent or legal guardian, who should review these Terms with you.
- If you are a minor, you must have the permission of a parent or legal guardian before starting a subscription or making any purchase. Purchases are made through your Google Play account, and the account holder is responsible for them.
- In some countries the age at which a person can consent to the processing of their personal data online is higher than 13 (up to 16 in some EU countries). Where the law requires it, a parent or guardian must give that consent.
3. License and restrictions
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install and use the App on devices you own or control, for your own non-commercial use.
You may not, except to the extent the law expressly allows:
- copy, modify, translate or create derivative works of the App;
- decompile, disassemble or reverse engineer the App, or attempt to extract its source code;
- sell, rent, lend, sublicense, distribute or otherwise make the App available to others;
- remove or alter any copyright, trademark or other notices in the App;
- circumvent, disable or interfere with the App’s subscription checks, ads, lives system or other technical measures, or use cheats, modified versions of the App or unauthorized tools;
- systematically download, scrape or extract the App’s quiz content or images, or use the App to build a competing product or dataset.
The App is licensed, not sold. We and our licensors keep all rights not expressly granted to you.
4. Google Play terms
The App is distributed through Google Play. Your download and use of the App, and any purchase you make in it, are also subject to the terms and policies of Google Play, including the Google Play Terms of Service. If those terms conflict with these Terms regarding payments, billing or refunds, the Google Play terms apply to that extent. Google is not a party to these Terms and is not responsible for the App or its content.
6. Refunds
Because payments are processed by Google Play, refund requests are handled under Google Play’s refund policy. You can request a refund through Google Play. You are also welcome to contact us (see Contact and developer details) and we will try to help, although in most cases only Google can issue the refund itself.
This does not limit any mandatory rights you have as a consumer, including your rights if the App or your subscription does not conform to what was promised (see Section 7).
7. EU right of withdrawal
If you are a consumer in the European Union or European Economic Area, you generally have a right to withdraw from a contract for digital content or digital services within 14 days without giving a reason. Premium is supplied immediately after purchase. Where Premium is digital content and you have given your express consent to immediate supply and acknowledged that you thereby lose your right of withdrawal (Google Play’s checkout is where this consent is requested), your right of withdrawal ends once supply begins. Where the law treats Premium differently, for example as a digital service, you keep your right of withdrawal to the extent the law provides, and you may have to pay a proportionate amount for the period before you withdrew. To exercise a right of withdrawal, you can use Google Play’s refund process or contact us (see Contact and developer details).
This does not affect your legal guarantee of conformity under EU law (Directive (EU) 2019/770 and national laws implementing it). If the App or Premium does not work as described, you are entitled to have it brought into conformity or, where the law allows, to a price reduction or to end the contract. These rights cannot be excluded.
8. Advertising and rewarded ads
- The free version of the App shows ads, including full-screen (interstitial) ads, for example after you finish a quiz, before the results screen, or when you run out of lives. Premium subscribers do not see ads.
- The App also offers rewarded ads: you may choose to watch an ad to receive an in-app benefit, such as replaying a quiz or restoring lives (restoring lives this way is limited, currently to once every 24 hours). In the free version, some of these benefits (for example, replaying a quiz) are available only by watching a rewarded ad; you are never required to watch one, but without it the benefit is not granted. Premium subscribers get these benefits without ads.
- Rewards are granted only if the ad is shown and completed. Ads may not always be available (for example, without an internet connection or if no ad is available), and we do not guarantee that a rewarded ad will be offered at any given time.
- Ads are provided by third-party ad networks. We do not control the content of third-party ads or the websites or apps they link to, and we are not responsible for them. How ad partners handle data is described in our Privacy Policy.
9. Lives and other in-app features
Lives, levels, ranks, scores, progress and similar in-app features are part of the game experience only. They have no monetary value, cannot be bought or sold for real money outside the App, cannot be exchanged for cash or any other goods, and are not your property. We may adjust how they work (for example, the number of lives or how they refill) as part of updates to the App.
Your quiz progress is stored on your device. The App has no user account and no cloud backup of your progress. If you uninstall the App, clear its data or change devices, some or all progress may be lost, and we may not be able to restore it.
10. Educational content disclaimer
The quiz questions, artwork titles, artist attributions, dates, movements and other information in the App are provided for entertainment and general educational purposes. Much of this information is based on data from public museum collections and other sources. Although we try to keep it accurate, it may contain errors, simplifications or outdated attributions, and art-historical information is sometimes disputed. The App is not a scholarly reference and should not be relied on as one.
If you notice an error, please tell us — the “Contact developer” option in the App’s settings opens an email to us, or see Contact and developer details. We appreciate corrections and will review them.
11. Third-party content and artwork
- Artwork images and related information in the App are obtained from public museum collections and their public services, including the Art Institute of Chicago, The Metropolitan Museum of Art and the Cleveland Museum of Art, and from Wikimedia projects. Some images are bundled with the App or used in its promotional materials.
- The artworks and images remain the property of their respective rights holders. Many of the works shown are in the public domain; others may be made available under the terms set by the relevant institution or rights holder. Reference to these institutions does not mean that they sponsor, endorse or are affiliated with the App.
- Loading images requires an internet connection and depends on the availability of these third-party services, which we do not control. Some images or content may be temporarily or permanently unavailable.
- You may use the App’s content only within the App as described in these Terms. Nothing in these Terms gives you rights in third-party works; any separate use is subject to the terms of the relevant rights holder.
Copyright complaints
We respect intellectual property rights. If you believe that content in the App infringes your copyright or other rights, please email us (see Contact and developer details) and include:
- identification of the work you believe is infringed;
- where the content appears in the App (for example, the category, quiz or screen, and the artwork title or a description or screenshot), so that we can locate it;
- your name and contact details (including your email address), and, if you act on behalf of a rights holder, your relationship to them;
- a statement that you believe in good faith that the use is not authorized by the rights holder, its agent or the law, and that the information in your notice is accurate.
We will review each complaint and, where appropriate, remove or disable access to the content concerned.
12. Optional survey
The App’s settings may include a link to an optional survey. The survey is hosted on Google Forms and opens in your browser. Taking part is voluntary. Information you enter in the survey is processed by Google under Google’s own terms (Google Terms of Service) and Privacy Policy. Please do not include sensitive personal information in your answers.
13. Our intellectual property
Except for third-party content described in Section 11, the App and its contents — including its software, design, user interface, graphics, text, quiz structure and selection, and the name “Art Master” and related logos — are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer any of these rights to you.
If you send us feedback, suggestions or error reports, you allow us to use them to improve the App without any obligation to you. You are not required to send us feedback.
14. Acceptable use
When using the App, you agree not to:
- break any applicable law or infringe the rights of others;
- interfere with or disrupt the App, its backend services or the third-party services it relies on (such as the museum image services), for example by sending automated or excessive requests;
- attempt to gain unauthorized access to the App’s systems or to other users’ data;
- commit fraud involving purchases, subscriptions, trials, refunds or ad rewards, or generate artificial ad impressions or clicks;
- use the App in any way that violates these Terms.
15. Updates, changes and discontinuation
- We may release updates that fix bugs, change or remove features or content, or add new ones. Some updates may be required to keep using the App.
- Quiz content and images may change over time, including when third-party sources change or withdraw content.
- We may stop offering or supporting the App, in whole or in part. If we discontinue the App or Premium, we will try to give reasonable advance notice where practical. If you have an active paid subscription at that time, you will be able to cancel it in Google Play, and you keep any rights to a refund or price reduction that you have under applicable law.
- These changes do not affect your statutory rights, including your rights under Section 7.
16. Termination
You can stop using the App at any time by uninstalling it. Remember to cancel any active subscription in Google Play, because uninstalling does not cancel it.
We may suspend or end your license to use the App if you seriously or repeatedly breach these Terms, or if required by law. Where reasonable, we will tell you the reason. If we end your license because of our own decision and not because of your breach, you keep any rights to a refund you have under applicable law.
Sections that by their nature should survive termination (for example, Sections 9, 10, 11, 13, 17, 18, 19 and 21) continue to apply.
17. Disclaimers
We work to keep the App running well, but, to the maximum extent permitted by law, the App is provided “as is” and “as available”. We do not guarantee that the App will be uninterrupted, error-free or always available, that all images will load, or that quiz content will be complete or accurate. Loading quizzes and images requires an internet connection. The App relies on third-party services (such as Google Play, Google Firebase, ad networks and museum image services) that we do not control.
Nothing in these Terms excludes or limits any warranty, guarantee or right that cannot be excluded or limited under applicable law, including the legal guarantee of conformity for digital content. Nothing in these Terms affects your statutory rights as a consumer.
18. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for indirect or consequential losses that were not reasonably foreseeable when you started using the App, or for loss of in-app progress, lives or other in-app features that have no monetary value;
- our total liability to you in connection with the App is limited to the amount you paid for Premium in the 12 months before the event giving rise to the claim.
These limitations do not apply to liability for intent or gross negligence, for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be excluded or limited by law, including rights you have as a consumer that cannot be waived.
19. Questions and governing law
- If something goes wrong, please write to us first (see Contact and developer details) — we will do our best to help.
- These Terms are governed by the laws of the country where we are established (see Contact and developer details). If you are a consumer, you keep the mandatory protections of the law of the country where you live.
20. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the App, to Premium or to the law. When we do, we will update the “Last updated” date above. If a change is material, we will highlight it on this page and, where appropriate, in the App. Changes will not apply retroactively. If you do not agree to the updated Terms, you should stop using the App and cancel any subscription; continuing to use the App after the changes take effect means you accept them.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be applied to the greatest extent permitted by law. Our failure to enforce any provision is not a waiver of our right to do so later.
22. Contact and developer details
If you have questions about these Terms, want to report an error in quiz content or submit a copyright complaint, please contact us.
